Does New York HUT apply to my fleet?
If you operate trucks with a gross weight over 18,000 lbs on New York public highways, you owe New York Highway Use Tax — it does not matter where your fleet is based. Before the first qualifying vehicle moves in the state, each one needs a HUT certificate of registration and a decal, $1.50 per vehicle (tax.ny.gov).
What triggers HUT?
The threshold is a gross weight over 18,000 lbs. If a truck crosses that line and operates on a New York public highway, HUT applies. A carrier that elects New York's unloaded-weight filing method has lower thresholds instead: over 8,000 lbs unloaded for a truck, over 4,000 lbs for a tractor (tax.ny.gov). One carve-out: toll-paid portions of the New York Thruway are excluded from the tax.
What do I need before my truck enters New York?
A HUT certificate of registration and a decal, one per qualifying vehicle, at $1.50 each, through NY's HUT program. The certificate comes before the vehicle operates in New York, not after.
When are HUT returns due?
The default filing frequency is quarterly. Returns are due the last day of the month following the end of each quarter:
- Q1 (Jan–Mar): April 30
- Q2 (Apr–Jun): July 31
- Q3 (Jul–Sep): October 31
- Q4 (Oct–Dec): January 31
A due date that lands on a Saturday, Sunday, or legal holiday moves to the next business day. Current example: October 31, 2026 is a Saturday, so the Q3 2026 return runs to Monday, November 2, 2026. The rule is in the MT-903-I instructions.
Does my filing frequency ever change?
New York reclassifies filers based on prior-year liability. Over $12,000 last year: monthly filing. $1,200 or less, and subject to HUT for the entire preceding year: annual filing. Everyone else stays quarterly. The thresholds are in the MT-903-I instructions.
How do I file?
Two options: Web File through New York's Online Services, or paper on Form MT-903.
I'm not based in New York — does this still apply?
Yes. The trigger is operating on New York public highways, not where the fleet is registered or headquartered. A truck running through the state over the weight threshold owes HUT, and it needs the certificate before it does.
