Interstate · CDL The lead: English-proficiency enforcement is headed into the rulebook itself
On August 10, FMCSA published a proposed rule — an NPRM, not yet in force — that would write the English Language Proficiency out-of-service violation directly into the federal safety regulations, aligning them with the roadside criteria inspectors have already been using since June 25, 2025 (91 FR 51422).
What this changes today: nothing. Drivers who can't demonstrate English proficiency at roadside are already being placed out of service — that started June 25, 2025 under CVSA's criteria (CVSA notice). The proposal makes that permanent and uniform in the regulations themselves.
Dates: Comments close October 9, 2026. If your fleet has a view on how this should be enforced, this is the window.
The story so far: executive order April 28, 2025 → FMCSA enforcement guidance May 20, 2025 → out-of-service enforcement at roadside June 25, 2025 → proposed codification August 10, 2026. Eight weeks from memo to parked trucks, and the paperwork is still catching up a year later.

If your trucks' brakes are inspection-ready (this week's emphasis), your Clearinghouse queries have run within the last 12 months, and IFTA Q3 is on your calendar for October, nothing published in this period requires action from a 5–50 truck fleet. The ELP proposal is the one to watch, not the one to act on.
